General Terms and Conditions for competitions

1. Introduction

These general terms and conditions for participation in competitions organised by companies within the Instabee group, including but not limited to Instabee Group AB, Budbee Group AB and Instabox Group AB, (“Instabee”, “we”, or “us”) and featuring in any of Instabee’s apps or websites (collectively, our “Platforms”), apply to users of the Platforms, and any other third party, that participate in such a competition (“User”).

By participating in Instabee’s competitions, Users are deemed to have accepted and understood, and agree to be bound by (i) these general terms and conditions (“GTC”); and  (ii) the specific instructions, rules and conditions of the announced competition (jointly referred to as the “Terms”). The User also acknowledges that Instabee processes the User’s personal data in accordance with Instabee’s External Privacy Notice.

Instructions, rules and conditions specific to each competition are, if any, disclosed in the Platform where the competition is held (“Competition Notice”). In the event of discrepancy between the GTC and the Competition Notice, the Competition Notice shall prevail.

2. Requirements to participate

Unless otherwise provided in the Competition Notice, employees of Instabee and their immediate families, as well as persons connected with a competition and their immediate families, such as, sponsors of awards and their agents, are not eligible to enter the competition event.

If nothing else is stated in the Competition Notice, the User must reside in Sweden, Denmark, Finland or the Netherlands. Users are responsible for determining whether their participation in a competition is compliant with applicable laws in the User’s jurisdiction.  

Instabee assumes that by participating in a competition, the User warrants that it satisfies the age limits set out in the Competition Notice. If no such age limit is set in the Competition Notice, the User must be 18 years old and/or otherwise be authorized and have legal power to accept the Terms with binding effect in accordance with the laws in the country where the competition is made available to the User.

By participating in a competition, Users warrant that all information submitted by the User is true, current and complete. Instabee reserves the right to verify the eligibility of all Users. The User must ensure that the contact details provided upon the requested competition’s submission is correct, as the contact information may be used to send the User information, further instructions and awards (where applicable).

3. Disqualification

Instabee reserves the right to disqualify discretionarily the User if Instabee has reasonable grounds that the User does not satisfy the requirements to participate in the competitions or if the User is in breach of the Terms.

4. Participation in competitions

Unless otherwise provided in the Competition Notice, participation in a competition organised by Instabee is free of charge.

Instabee does not assume responsibility for any errors, omissions, interruptions, deletions, defects, delay in operation or transmissions, communications line failure, destruction, alteration of, or unauthorised access to submissions, submissions lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes.

5. Winners and awards

Winner of each competition is chosen on the basis of the specific conditions set out in the Competition Notice and only qualifying Users participating in the event are eligible to be selected winners for that competitive event. Winners are notified within the Platform, or in the manner and within the time periods specified in the Competition Notice. 

Return of any award notification, as undeliverable or failure to reply as specified in the notification (and within the time stated), may result in disqualification and selection of an alternate winner. 

Claims for an award must be made in the manner and within the time specified on the Competition Notice. Failure to claim an award within this time or in the manner specified may result in disqualification and selection of an alternate winner.

Awards are awarded at the discretion of Instabee and no awards will be awarded as a result of improper actions by or on behalf of any User.

Unless otherwise stated in the Competition Notice, awards are non-transferable, and the Users are not allowed to substitute or request for other monetary alternatives.

The winner claiming for an award is liable for any taxes, levies, administrative fees, insurances, transfers, or any expenses (as the case may be).

6. Privacy and personal data

The User acknowledges Instabee’s processing of the User’s personal data for the purposes of the competition. As part of providing any competition, Instabee may contact the User by mail, telephone, SMS, e-mail, push notifications or directly via the Platforms for the purpose of communicating regarding the competition. 

All processing of the User’s personal data will be made in accordance with Instabee’s External Privacy Notice, unless otherwise is expressly stated. The User can find the External Privacy Notice in the Platforms, as well as here.

Instabee may engage sponsors and/or subcontractors to carry out its obligations under these Terms. Any effects on the processing of the User’s personal data through use of subcontractors will be handled in accordance with Instabee's External Privacy Notice.

7. Instabee’s liability towards the User

Insofar as is permitted by law, Instabee shall be held harmless for any damages, loss, injuries or disappointments suffered by any User participating in a competition or resulting from accepting any awards. Furthermore, Instabee is not liable for any technical or administrative malfunctions, errors or defects (such as computer on-line systems, servers, or providers, computer equipment or software, failure of any email or any web site) resulting from a User’s participation in the competition. Instabee shall be released from any and all obligations upon transfer of the award.

8. User’s liability for breach of the Terms 

By accepting these Terms, the User acknowledges that the User is responsible for and Instabee may hold the User liable for any damages, losses or costs that Instabee incurs as a result of the User’s breach of these Terms.

9. Modifications of the Terms

Instabee may modify the Terms from time to time. All changes will be published at Instabee’s Platforms. Users’ continued participation in the announced competitions, after the date on which the changes to the Terms come into effect, is deemed as an acceptance of the changes to the Terms.

10. Applicable law and dispute resolution

The Terms shall be governed by the substantive laws of Sweden. Any dispute, controversy or claim arising out of or in connection with the Terms, or the breach, termination or invalidity thereof, shall be finally settled by the Swedish General Court in Stockholm.

Alternatively, the User may refer the claim to Alternative Dispute Resolution in the following ways:

1. The User can file the claim to the National Board for Consumer Disputes; or
2. The User can get help resolving disputes with traders online without going to court via the European Commission's Website for Dispute Resolution.
